Who is responsible

Software Development - Rafal Darlak, NIP 8181728292, is responsible for the personal information used to run this website and newsletter. Contact support@rafaldarlak.com with privacy questions or requests concerning your information.

Joining the newsletter

When you sign up, the website sends your email address and the location of the signup form, such as the hero or newsletter section, to Kit. Kit manages the subscriber list, confirmation messages, and newsletter delivery. New subscribers are asked to confirm their subscription by email.

Your consent is the basis for sending the newsletter you request (Article 6(1)(a) GDPR). The first issue is coming soon, followed by one email a week. Subscribing is voluntary. You can withdraw your consent at any time using the unsubscribe link in an email, or by contacting us. Withdrawing consent does not affect processing that was lawful before withdrawal.

The form also checks a hidden field and the time since the form loaded to help reject automated submissions. These checks are processed by the website's API; they are not sent to Kit as subscriber fields.

Visiting the website

Microsoft Azure Static Web Apps hosts the website and its signup API. Cloudflare provides DNS for the domain. The application logs signup outcomes and the form location for troubleshooting; its custom signup logs do not include your email address or the submitted request body.

Hosting and network providers may process technical information to deliver and protect their services. This is separate from the application's custom logs. The website's source code does not include an analytics widget, advertising pixel, or embedded social feed. Social links open the respective platform, where that platform's privacy terms apply.

Service providers and international processing

The services used for this site include Kit for newsletter delivery, Microsoft Azure for hosting, Cloudflare for DNS, and Google Workspace for support email. These providers can process information outside Poland and the European Economic Area, depending on the service and its contractual arrangements.

Kit describes its international transfer safeguards in its Data Processing Addendum. Further provider information is available in the Microsoft Privacy Statement, Cloudflare Privacy Policy, and Google Workspace Data Processing Amendment.

Email measurement

Kit records newsletter opens using a small tracking image associated with an email, and records clicks on tracked links. These interactions can be associated with your subscriber profile. They help us understand which messages and topics readers engage with. Blocking remote images in your email client can prevent the open-tracking image from loading, but does not prevent the recording of tracked link clicks.

Retention

Unsubscribing stops newsletter delivery; it does not necessarily delete a subscriber profile or its history from Kit. You can separately request deletion by contacting us. Records may need to be retained where a legal obligation or another applicable basis requires it.

Active subscriber information is kept while the subscription is in place. Kit can retain inactive or unsubscribed profiles and their history until they are deleted; this website does not run automatic deletion after a fixed period. Retention after withdrawal is limited to what is needed to respect the opt-out, establish the subscription history, or meet applicable legal obligations and handle claims. A deletion request is assessed against those purposes rather than treated as a new unsubscribe request.

Technical information is retained according to the hosting and network providers' service terms and the period needed to operate, protect, and troubleshoot the service. Support correspondence is retained for the time needed to resolve the request and any related legal obligations or claims. These periods depend on the purpose; there is no single automatic deletion deadline covering all providers and records.

Operational processing

Operating and securing the website, preventing abuse, answering support requests, and maintaining necessary subscription and delivery records are based on our legitimate interests in providing a reliable service (Article 6(1)(f) GDPR). Email engagement reports help us evaluate the newsletter, subject to applicable consent requirements and your right to object. Where processing is required by law, the basis is the relevant legal obligation (Article 6(1)(c) GDPR).

The site does not make automated decisions that produce legal or similarly significant effects on you.

Your choices and rights

Depending on the processing and applicable law, you can request access to your information, correction, deletion, restriction of processing, or portability. You can object to processing based on legitimate interests and withdraw consent for the newsletter at any time. To make a request, email support@rafaldarlak.com.

You can also lodge a complaint with a data protection authority, including Poland's President of the Personal Data Protection Office (UODO).
